DMCA Copyright Policy

1. Copyright Compliance

KickOff Live respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act (“DMCA”), we have adopted a policy to respond to notices of alleged copyright infringement that comply with the DMCA and other applicable laws.

We reserve the right to remove content that is alleged to be infringing and to terminate the accounts of repeat infringers in appropriate circumstances.

3. Filing a DMCA Takedown Notice

To submit a copyright infringement notification, please provide our designated agent with a written communication containing the following information:

  1. A physical or electronic signature of the copyright owner or a person authorised to act on their behalf.
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple works are covered, a representative list of such works.
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity, with enough detail for us to locate it (e.g., the specific URL or page where the material appears).
  4. Your name, address, telephone number, and email address so that we can contact you.
  5. A statement that you have a good faith belief that the use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorised to act on behalf of the owner of an exclusive right that is allegedly infringed.

4. Counter-Notification

If you believe that material you posted on the Site was removed or access to it was disabled as a result of a mistake or misidentification, you may submit a counter-notification containing the following information:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access was disabled.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, telephone number, and email address, and a statement that you consent to the jurisdiction of the federal court in your judicial district (or the federal court located in London, England if you are outside the United Kingdom), and that you will accept service of process from the person who provided the original notification.

Please send your counter-notification to the designated agent at the address or email listed above. Upon receipt of a valid counter-notification, we will forward it to the original complainant and restore the removed material within 10–14 business days unless the complainant files a court action seeking to restrain the infringement.

5. Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, we maintain a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers. We also reserve the right to remove content and terminate accounts at our sole discretion, without prior notice, for any reason, including infringement of third-party intellectual property rights.

6. Misrepresentations

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages, including costs and attorneys' fees, incurred by the alleged infringer, by any copyright owner or copyright owner's authorised licensee, or by a service provider. If you are unsure whether material infringes your copyright, we recommend consulting with legal counsel before submitting a notification.

7. Non-DMCA Jurisdictions

If you are located outside the United States and believe that your copyright has been infringed, please provide us with a notice containing the same information described in Section 3 above. We will review and respond to all valid notices in accordance with applicable local laws and international copyright treaties.
